A Los Angeles judge has denied Cher‘s request for her son Elijah Blue Allman to be placed under a temporary conservatorship.
During a court hearing on Friday, April 24, the court rejected the pop star’s bid to appoint a conservator of Allman’s estate, citing a lack of “sufficient urgency” despite the singer’s concerns that he is “gravely disabled” due to mental health and substance abuse struggles, People reported.
The case was dismissed without prejudice, meaning Cher, 79, can file again at a later date.
Us Weekly has reached out to Cher and Allman’s attorneys for comment.
According to People, Allman, 49, appeared at the hearing via a video call from a psychiatric hospital, where he is currently in custody “in an attempt to restore him to competency” as he faces criminal charges for two different cases in New Hampshire.
Because Elijah is in a hospital and facing pending charges, the judge argued that Cher’s son will likely be unable to access the money he receives from his late father Gregg Allman‘s trust.
Earlier this month, Cher filed for a conservatorship of Elijah’s estate for a second time. (Her first conservatorship petition in 2023 was denied in January 2024 after a judge found Elijah “has managed his finances,” “has an apartment” and “has remained drug-free” after submitting “several drug tests.”)
According to her latest petition obtained by Us, Cher claimed Elijah “has declined communication with most people,” leaving her unable to discuss her son’s preferences concerning the appointment of a temporary conservator.
“Due to various issues pertaining to his illness and drug use, Elijah bounced between various hotels and Airbnb’s and did not have a fixed residence,” Cher claimed in court documents.
She also alleged that her son has “no ability to manage money and any dollar he receives from his father’s trust (his only source of income) is immediately squandered without regard for his liabilities or well-being.”
“Elijah spends any money he gets immediately, and almost exclusively money on drugs, expensive hotels and limousine transportation. In the meantime, he has failed to pay any income taxes, accruing a $200,000 tax bill,” Cher and her legal team claimed in court documents.
Legal documents also alleged that Elijah “had an $18,000 bill with a drug dealer who tracked him down, resulting in Elijah borrowing money from a friend in order to avoid being harmed.”
Cher and her legal team also claimed “Elijah has been thrown out of a total of 18 hotels because he has made guests feel uncomfortable, screaming obscenities and acting erratically. … His mental health has severely deteriorated, his financial situation is terrible and his drug dependency is at its worst.”

Similar to the 2023 conservatorship petition, Cher and her legal team stood by the claims that, “Elijah is entitled to regular distributions from the trust, but given his ongoing mental health and substance abuse issues, [Cher] is concerned that any funds distributed to Elijah will be immediately spent on drugs, leaving Elijah with no assets to provide for himself and putting Elijah’s life at risk.”
Cher shares Elijah with her late ex-husband, to whom she was married from 1975 to 1979. Gregg died at the age of 69 in 2017 after a battle with throat cancer.
